TERMS & CONDITIONS

Entry

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over that have purchased an Eligible Red Smoke Alarm Product. There is no entry fee.
3. Employees (and their immediate families) of Red Smoke Alarms, trade wholesalers or retailers of Red Smoke Alarms (including their officers and employees) (e.g. Electrical Wholesalers) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Red Lotto Promotion commences on 02/01/24 at 12:00am AEDST and closes at 11:59pm AEST on 02/07/24 ("Promotional Period").
5. To be eligible to enter, individuals must, during the Promotional Period, purchase in a single transaction, any Eligible Red Smoke Alarm Product.
6. To enter, individuals must, during the Promotional Period, visit www.thinkredrewards/redlotto, follow the prompts to the promotion entry page, input the requested details (including but not limited to their full name, full mailing address, phone number, email and date of birth), upload their serial number from the Eligible Red Smoke Alarm Product purchased when prompted and then submit the fully completed entry form.
7. Entrants will be notified immediately on screen, in writing, whether they have won an instant prize. Any winner of an instant win prize that exceeds $250 will also be published online at www.thinkredrewards/redlotto from 04/07/24.
8. Entrants must retain evidence of the purchase of the Eligible Red Smoke Alarm Product, including the smoke alarm serial number, physical or photo, along with their original purchase receipt(s) / invoice(s) for all entries as proof of purchase. Failure to produce the proof of purchase and serial numbers for all entries when requested may, in the absolute discretion of Red Smoke Alarms, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) / invoice(s) must clearly specify the wholesaler of purchase and that the purchase was made during the Promotional Period but prior to entry.
9. Red Smoke Alarms reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who Red Smoke Alarms has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at Red Smoke Alarms discretion. Failure by Red Smoke Alarm to enforce any of its rights at any stage does not constitute a waiver of those rights. Red Smoke Alarms legal rights to recover damages or other compensation from such an offender are reserved.
10. Incomplete or indecipherable entries will be deemed invalid).
11. Multiple entries are permitted, subject to the following: (a) only one (1) entry permitted per Eligible Red Smoke Alarm Product serial number; and (b) each entry must be submitted separately and in accordance with entry requirements.
12. If there is a dispute as to the identity of an entrant, Red Smoke Alarm reserves the right, in its sole discretion, to determine the identity of the entrant.
13. Red Smoke Alarms decision is final and no correspondence will be entered into.

Prizes

14. The instant win prizes available to be won during the Promotional Period are:

    • 6 x $5,000 Digital Visa Gift Card;
    • 300 x $50 Digital Visa Gift Card; and
    • 3,000 x $5 Red Dollar Rewards (provided as a unique code to add to Members' Red Smoke Alarms Red Dollar Rewards Program Account) refer to clause 19.
15. Any advertisement or promotion of the instant prizes to win are only suggested uses of the Digital Visa Gift Cards. Red Smoke Alarms is not offering those experiences or offers as prizes in the Red Lotto Promotion and makes no representation that those are prizes to be won in the Red Lotto Promotion.
16. The Digital Visa Gift Cards will be delivered via email and winners are responsible for ensuring that the email address provided is correct. Winners of the $5,000 Digital Visa Gift Card will be required to confirm they have received the prize via email and phone to Red Lotto providers.
17. The Digital Visa Gift Card is valid for the period shown on the Digital Visa Gift Card and in the email containing the Digital Visa Gift Card. Card expiry can also be found on the face of the Digital Visa Gift Card as shown in the True Rewards App. At the expiry of the Digital Visa Gift Card any unused balance will be forfeited. 18. Any ancillary costs associated with redeeming any Digital Visa Gift Card or voucher are not included in the prize. Any unused balance of any Digital Visa Gift Card or voucher will not be awarded as cash. Redemption of any Digital Visa Gift Card or voucher is subject to any terms and conditions of the issuer including those specified on the Digital Visa Gift Card.

19. The instant win prizes available to be won during the Promotional Period are:

    1. are only able to be used by Members as part of the Red Dollars Rewards Programs; www.thinkredrewards.com.au/reddollars/Terms;
    2. hold no cash value and cannot be redeemed for cash; and
    3. are not transferable.
20. Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem a prize at/by the time stipulated by Red Smoke Alarms or the entry is determined to be invalid, then the prize will be forfeited.
21. If any prize is unavailable, Red Smoke Alarms, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
22. The total prize pool is valued at $60,000.
23. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
24. A draw for any prizes that are won but are not claimed or any $5,000 Digital Gift Cards that remain unwon may take place at 11:00am AEST on 24/07/24 at iGoDirect Pty Ltd, 41 Stubbs Street, Kensington, VIC 3031, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the draw and their names will be published at www.thinkredrewards/redlotto on 26/07/24. For clarity, ‘not claimed’ means any prize that has not successfully been sent to or delivered to a winner.

General

25. Entrants consent to Red Smoke Alarms using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Red Smoke Alarms.
26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Red Smoke Alarms, including but not limited to technical difficulties, unauthorised intervention or fraud, Red Smoke Alarms reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
27. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. 
28. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
    
29. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool and are won but not claimed will be awarded in the unclaimed prize draw.
30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Red Smoke Alarms (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion
31.  Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Red Smoke Alarms (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under Red Smoke Alarms control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Red Smoke Alarms) due to any reason beyond the reasonable control of Red Smoke Alarms; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of / taking of the prize.
32. Red Smoke Alarms collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. Red Smoke Alarms will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://redsmokealarms.com.au/privacy/, In addition to any use that may be outlined in Red Smoke Alarms Privacy Policy, Red Smoke Alarms may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of Red Smoke Alarms. Red Smoke Alarms will not disclose PI to any entity outside of Australia.
33. Red Smoke Alarms reserves the right to, from time to time add, remove, or exclude certain products from the list of Eligible Red Smoke Alarm Products

34. Where entrants have returned Eligible Red Smoke Alarms Products or entrants have been refunded for any Eligible Red Smoke Alarms Products in respect of which entrants won a prize, then Red Smoke Alarms may:

    1. if prize is Red Dollars, reverse (i.e. debit) any Red Dollars which have been issued (i.e. credited) to any winner; and/or
    2. if the prize is a Digital Visa Gift Card, cancel the Digital Visa Gift Cards issued to the winner; and/or
    3. take action to recover the value of those prizes as a debt due and payable to Red Smoke Alarms.
35. Serial numbers on returned Eligible Red Smoke Alarm Products that have already been used to enter the Red Lotto Promotion will become invalid and any person seeking to enter the Red Lotto Promotion using that serial number will be ineligible (unless otherwise determined by Red Smoke Alarms). Any entrants whose serial numbers are deemed invalid will have the opportunity to provide another form of evidence that indicates proof of purchase such as their original purchase receipt or invoices. Red Smoke Alarms is not responsible for and excludes all liability arising from or in connection with any invalid serial numbers, including but not limited to any claim by a purchaser of an Eligible Red Smoke Alarm Products to enter the Red Lotto Promotion. Red Smoke Alarms may also reverse and/or cancel prize (including Red Dollars and Digital Visa Gift Cards) which have been allocated or issue to an entrant if there are any other grounds which we consider, in our reasonable discretion, justify a reversal or cancellation, for instance, if the prize were allocated to an entrant by mistake (including by reason of our error) or if a entrant earned them by misusing an offer, or through fraudulent means.
36. Entrants agree that, except to the extent that these Terms expressly provide otherwise, Red Smoke Alarms do not need to notify entrants in advance, or give any reasons, with regard to any action we take under these Terms and Conditions

37. Entrants acknowledge and agree that there may be:

    1. delay in issuing entrants with, or non-issue to entrants of, any prizes;
    2. acts, errors or omissions by Red Smoke Alarms in the course of providing any prizes (including as referred to in these Terms and Conditions);
    3. loss, theft or damage to any prizes in the course of the issuing them to any winner; or
    4. a suspension and/or termination of the Red Lotto Promotion, including the ability for to enter and instantly win Red Lotto prizes,
    
    and to the maximum extent permitted by law, Red Smoke Alarms will not be liable to entrants in any way for any cause in connection with such matters, including for any unused Red Lotto balance in winner’s Visa Gift Cards or Red Dollar accounts at the time of termination, and entrants release Red Smoke Alarms from all and any demands, claims, actions or proceedings in respect of such matters.
38. Entrants agree that any comments, suggestions or recommendations entrants may receive from Red Smoke Alarms or others as part of Red Lotto Promotion may not be suitable, accurate or complete and entrants must not rely on them in a way which may give rise to any loss or damage. If entrants intend to rely on anything in connection with the Red Lotto Promotion, their reliance should be based solely on their own judgement, including as to the extent to which entrants should obtain or use any prizes.
39. The issue of prizes is conditional on entrants purchasing normal quantities of goods. We reserve the right to determine what constitutes a normal quantity of any good and apply purchase limits for the issuing of prizes. A purchase of goods may exceed a normal quantity even if the purchase is split over more than one transaction.
40. Prizes are personal and may only be collected and used for entrant’s own personal use. Entrants may not collect or use prizes for any commercial purpose, including but not limiting to any scheme or arrangement to acquire and sell prizes to any person.
41. Prizes cannot be exchanged or refunded except as expressly set out in these Terms.
42. Red Smoke Alarms may terminate the Red Lotto Promotion for any reason without notice.
